Terms of Use
1. Agreement
These terms govern your use of the Joul app and website (the “Service”), operated by Julian Stastny, an individual (“Joul”, “we”). By using the Service you agree to them. If you don't agree, don't use it. Our Privacy Policy explains how we handle your data.
2. Who can use Joul
You must be at least 16 years old and able to enter a binding agreement. Joul needs a WHOOP membership to work as intended. Use of Joul does not give you any rights in your WHOOP account.
3. Joul is not medical advice
Joul is a tracking tool. Calorie burn comes from WHOOP's estimates, and food calories, portions and macros are estimates too, including anything produced by AI photo analysis. Energy balance is not a guarantee of weight change. Joul does not diagnose, treat or prevent any condition and does not give personalised dietary advice. Targets we suggest are generic starting points. Talk to a qualified professional before changing your diet or exercise, especially if you are pregnant, are under 18, have a medical condition, or have a history of disordered eating. If tracking affects your wellbeing, stop using it and seek support.
4. Your account and data
You're responsible for the information you enter and for keeping your device secure. You can disconnect WHOOP and delete your data in the app at any time.
5. Subscriptions
- Joul is free to start. Joul Premium is a paid subscription, planned at $4.99 per month or $29.99 per year.
- Subscriptions are billed through your Apple ID and renew automatically unless cancelled at least 24 hours before the current period ends. Manage or cancel in your Apple ID settings. Refunds are handled by Apple under its policies.
- Free AI photo analyses are a limited trial, and photo logging under Premium is subject to fair use. Fair use means up to 100 photo analyses per month. We may adjust this limit with notice.
- We may change features and prices with notice. Price changes follow Apple's rules for existing subscribers.
6. Using Joul fairly
Don't misuse the Service: no unlawful use, no attempts to break, scrape or overload it, no reverse engineering except where the law allows, no using it to harm others, and no uploading images you have no right to use or that are unlawful.
7. AI features
AI results can be incomplete or wrong, especially for hidden ingredients, oils, sauces and portion sizes. You must review them before saving. We aren't responsible for decisions you make based on estimates.
8. Third parties
Joul works with WHOOP data that you choose to share. Joul is independent and is not endorsed by or affiliated with WHOOP. WHOOP's terms govern your use of WHOOP. Apple's terms apply to the App Store and purchases. Apple's standard Licensed Application End User License Agreement also applies to your use of the app, in addition to these terms.
9. Intellectual property
Joul, its design, code and branding belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app. Your food entries and photos remain yours, and you give us only the limited permission needed to run the Service for you, including sending photos for analysis when you ask.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent the law allows, including accuracy, availability and fitness for a particular purpose. We don't promise uninterrupted service or that WHOOP data will always be available. Consumer rights that the law where you live doesn't allow us to limit are not affected.
11. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose, or $50 if you paid nothing. Nothing here limits liability that can't be limited by law.
12. Ending use
You can stop using Joul at any time. We may suspend or end access if you breach these terms or to protect the Service. Sections that by their nature should survive will survive.
13. Changes
We may update these terms. If a change is material we'll tell you in the app before it applies. Continuing to use Joul after that means you accept the new terms.
14. Governing law and disputes
These terms are governed by the laws of Mexico, and disputes go to the courts of Mexico City, Mexico, subject to any mandatory consumer rights where you live.
